По поводу трудовых мигрантов, работающих в Брюховецком районе, наши граждане вопрос поднимали уже неоднократно. Мало того, мне не раз предлагали найти их всех и чуть ли не депортировать.

Почему-то многие считают, что мигранты из ближнего зарубежья живут и работают здесь, нарушая все мыслимые и немыслимые нормы законодательства. Возможно, где-нибудь в Москве, в Московской области, в крупных городах всё так и есть, но в тихой провинции сегодня это просто нереально.

Во-первых, они все на виду, во-вторых, контроль над ними установлен самый тщательный. Все работающие у нас мигранты осуществляют свою деятельность в строгом соответствии с действующим законодательством. За нарушения – привлекаются к ответственности. Как сами мигранты, так и их работодатели.

Здесь следует внести определенные пояснения. Существует статья 18.9 Кодекса об административных правонарушениях (Нарушение правил пребывания в Российской Федерации иностранных граждан и лиц без гражданства). Она регламентирует в числе прочего и ответственность должностных и юридических лиц за неисполнение целого ряда правил приема мигрантов. Любой работодатель, нарушивший эти правила, рискует попасть под санкции данной статьи. Так вот, штрафы она предусматривает до полумиллиона. А статья 18.15 (Незаконное привлечение к трудовой деятельности в Российской Федерации иностранного гражданина или лица без гражданства) предусматривает штраф до миллиона. Обращаю внимание, за каждого гражданина. Здесь – себе дороже. Проще оформить всё по правилам и не дразнить характер.

Начальник отделения по вопросам миграции отдела МВД России по Брюховецкому району Ирина Николаенко пояснила, что за первое полугодие текущего года в отделение было подано 63 уведомления о заключение трудовых договоров с иностранными гражданами. Из них 42 – с юридическими лицами, 21 – с физическими. О расторжении трудовых соглашений подано 35 уведомлений. Примечательно, что трудовых мигрантов в последнее время нанимают не только организации и предприятия, но и обыкновенные граждане, имеющие, конечно, для этого финансовые возможности. Строители, помощники по хозяйству, фасовщики товара – это основные специальности, востребованные на нашем трудовом рынке. Правда, была и врач из Таджикистана, но она в конечном итоге уехала работать в Тимашевский район. Помимо Таджикистана работают в Брюховецком районе граждане и других стран ближнего зарубежья – Узбекистан, Украина, Казахстан, Армения и т.д.

Как было сказано выше, контроль трудовой миграции ведется достаточно предметно. Нарушения периодически выявляются. Ниже размещена информация об административных протоколах, составленных отделением по вопросам миграции за первое полугодие:

Статья 18.9 (Нарушение правил пребывания в Российской Федерации иностранных граждан и лиц без гражданства), часть 4 КоАП РФ – 13.

Все организации и предприятия, нанимающие иностранных мигрантов, ведут себя весьма аккуратно. Руководители прекрасно понимают, что риски велики. Поэтому нарушения допускали физические лица. На них штрафы накладываются щадящие – 2-5 тысяч рублей.

За первое полугодие принято 2 решения о выдворении иностранных граждан за пределы Российской Федерации, с содержанием в специальном приемнике. Направлено в суд 6 дел о закрытии въезда в Российскую Федерацию иностранным гражданам, не покинувшим территорию страны после окончания законного срока пребывания. В целом, работа с мигрантами проводится довольно существенная.

Некоторые наши земляки периодически выражают возмущение по поводу того, что гастарбайтеры отнимают их рабочие места. Не без этого. Но, увы, такова общемировая практика. Социально-экономических предпосылок для этого масса, по ним монографии писать можно. Но совершенно очевидно, что группа людей, оторванных от дома и работающих вахтовым методом, дает гораздо более высокий коэффициент полезного действия, нежели местные жители.
